These Terms & Conditions apply to your use of this website and purchases from Atlas & Eden Pty Ltd (“Atlas & Eden”, “we”, “us” or “our”).
By placing an order, you agree to these Terms and the policies referred to within them. Please read these Terms together with our Privacy Policy, Shipping Policy and Returns & Refunds Policy.
1. Orders & Acceptance
All prices are displayed in Australian dollars and include GST where applicable.
Products, prices and availability may change before an order is placed.
When you submit an order, you are offering to purchase the selected products under these Terms. An automated order confirmation acknowledges that we have received your order but does not necessarily mean that it has been accepted.
Your order is accepted when we send confirmation that it has been dispatched, unless we expressly accept it earlier.
We may decline or cancel an order before dispatch where:
- A product is unavailable
- An incorrect price or product detail has been displayed
- Payment cannot be authorised or verified
- We reasonably suspect fraud or misuse
- We cannot deliver the order under the available shipping arrangements
- Accepting the order would breach a legal requirement
If payment has already been taken for an order we cannot fulfil, we will issue a full refund for the affected items.
2. Payments
Available payment methods are displayed at checkout and may include debit or credit card, Apple Pay, Google Pay and Afterpay.
Card and digital-wallet payments are processed through Stripe. Afterpay transactions are processed under Afterpay’s applicable terms.
We do not store your full payment-card details on our website servers.
All transactions are charged in Australian dollars.
3. Products & Information
We aim to ensure that product descriptions, ingredients, images, prices and availability are accurate. Minor errors may occasionally occur, and we may correct information before accepting an order.
Because our teas contain natural agricultural ingredients and are blended in small batches, variations in colour, texture, flavour, aroma and appearance may occur between batches.
Product images are illustrative. Colours may also vary according to lighting, photography and screen settings.
Please review the ingredient information and directions supplied with each product before use. Customers with food allergies or intolerances should review the ingredients listed on the relevant product page and contact us before ordering if they have any questions.
4. Botanical Products & Health Information
Our teas and botanical blends are sold as food and beverage products for enjoyment and sensory experience. They are not sold as medicines and are not intended to diagnose, treat, cure or prevent any disease or medical condition.
Product names, imagery and descriptive language may refer to flavour, mood, tradition, heritage, historical use or cultural associations. These references do not promise a particular medical, therapeutic or physiological outcome.
Information provided on this website is general and is not a substitute for professional medical advice.
If you are pregnant or breastfeeding, have a medical condition, are taking medication or have concerns about a particular ingredient, seek advice from an appropriately qualified healthcare professional before consuming herbal or botanical products.
5. Gift Orders
You may send an order directly to another person by entering the recipient’s delivery details at checkout.
You are responsible for ensuring that the recipient’s name, address and contact information are accurate.
Gift orders remain subject to these Terms and our published policies.
6. Promotions, Sale Items & Gift Cards
Only one promotional or discount code may be used per order unless an offer states otherwise.
Promotions are subject to their stated conditions and may be varied or withdrawn before an order is placed.
Sale, clearance and limited-edition items are not eligible for change-of-mind returns, but all rights under the Australian Consumer Law continue to apply.
Gift cards, when available, will be redeemable through our website and valid for at least the minimum period required by law. Gift cards cannot be redeemed for cash except where required by law.
7. Shipping & Delivery
Shipping options, charges and estimated delivery times are explained in our Shipping Policy and displayed at checkout where applicable.
You are responsible for providing complete and accurate delivery information. Please contact us promptly if you notice an error.
Additional shipping or redelivery charges may apply where an order cannot be delivered because incorrect or incomplete information was supplied.
Delivery times are estimates unless we expressly agree otherwise. If an order is significantly delayed or appears to be missing, please contact us so we can investigate and assist.
8. Returns & Consumer Guarantees
Our products come with consumer guarantees that cannot be excluded under the Australian Consumer Law.
Where a product fails to meet an applicable consumer guarantee, you may be entitled to a repair, replacement, refund or other remedy depending on the nature of the problem.
Nothing in these Terms excludes, restricts or modifies any right or remedy that cannot lawfully be excluded.

9. Website Use
You must not use this website:
- For unlawful or fraudulent purposes
- To interfere with its operation or security
- To introduce malicious code or attempt unauthorised access
- To collect information about other users without permission
- In a manner that infringes another person’s rights
We may restrict access where reasonably necessary to protect the website, our customers or our business.
10. Intellectual Property
Unless otherwise stated, the text, photography, graphics, product names, branding, design and other content on this website are owned by or licensed to Atlas & Eden Pty Ltd.
You may view and use the website for personal, non-commercial purposes. Content may not be copied, republished, commercially exploited or substantially reproduced without prior written permission.
11. Events Beyond Our Control
We are not responsible for delay or failure to perform an obligation to the extent that it is caused by an event beyond our reasonable control, such as natural disasters, severe weather, industrial action, transport disruption, supply interruption or government restrictions.
We will take reasonable steps to minimise disruption and will contact you where an event materially affects your order.
Where we cannot fulfil an affected order within a reasonable time, we may cancel it and refund the amount paid for the affected products.
Nothing in this section limits your rights under the Australian Consumer Law.
12. Changes to These Terms
We may update these Terms to reflect changes to our website, business practices or legal obligations.
Updated Terms will apply to orders placed after the revised version is published. An order already accepted remains subject to the Terms applying when it was placed, unless a change is required by law or agreed with you.
13. Governing Law
These Terms are governed by the laws of New South Wales, Australia.
Nothing in this section prevents the operation of any consumer-protection law or other mandatory law applicable to you.
